WHEREAS, the Consignor wishes to have certain items offered
by Luxe Touch Luxury Resale, and WHEREAS, Luxe Touch Luxury Resale wishes to represent the Consignor under the terms and conditions of the agreement.
THE PARTIES AGREE:
1. Consignment Eligibility
Handbags, Accessories, and Clothing Brands:
Chanel, Louis Vuitton, Hermes, Gucci, Saint Laurent, Prada, Dior, Burberry, Fendi, Versace.
Shoes and Boots:
Chanel, Louis Vuitton, Hermes, Gucci, Saint Laurent, Prada, Dior, Burberry, Fendi, Versace, Christian Louboutin, Manolo Blahnik, Jimmy Choo, Balenciaga, Golden Goose.
Jewelry:
Chanel, Louis Vuitton, Hermes, Gucci, Saint Laurent, Prada, Dior, Burberry, Fendi, Versace, Tiffany, David Yurman, Cartier, VCA, Rolex, Bvlgari.
From time to time and at Luxe Touch’s sole discretion, other Luxury Brands may be considered for consignment. No fashion brands will be considered at any time.
2. Contact
Please no emails, social media DM’s, phone calls or texts to inquire about the status of your item(s). Messages of this nature will generally go unanswered. The only exceptions are matters pertaining to price changes, applying payments to layaways or items you may be wishing to purchase, or item pickup.
If you notice your item is not on our social media and/or website, please see Item 5 for info.
If you notice your item has sold please see Item 9 for info.
3. Term
This agreement shall have a term of ninety (90) days minimum. This contract is open ended and renewable at the discretion of either party.
If the Consignor wishes to end the contract and pick up any item before 90 days, the associated commission that would have been due to Luxe Touch Designer Consignment upon the sale of the item is due at the time of pickup and must be paid in cash or e-transfer. Consignor must provide Luxe Touch Luxury Resale with 7 days notice for any item picked up before the minimum 90 day period. Failure to respect the above terms will result in all consigned items being returned to the Consignor. At Luxe Touch’s discretion consignors are contacted from time to time to pick up any unsold merchandise. Consignor will pick up the unsold merchandise within 14 days of notification.
4. Fees
Handbags, Accessories, and Jewelry:
Sale price up to $500: 50% to Consignor
Sale price $501-$1000 per item and under: 60% to Consignor.
Sale price $1001 per item and above: 70% to Consignor.
All Clothing and Shoes:
50% to Consignors, regardless of sale price.
5. Process
Items are accepted at Luxe Touch Luxury Resale’s sole discretion based on a number of factors including current trends, brand, condition, demand and volume of items already in stock. Luxe Touch Luxury Resale may refuse to accept or return any or all items consigned at any time if the terms of this contract are not respected.
Upon receipt, Luxe Touch will take all necessary steps to sell your item. Handbags, accessories and jewelry (in that order) are given priority. Additionally, items may or may notbe promoted/offered for sale via Luxe Touch’s website and/or social media outlets.
Consignor attests that they are not offering and will not offer the item for sale via any other method or venue while the item is in the possession of Luxe Touch Luxury Resale.
6. Pricing, Discounts and Markdowns
In consultation with the Consignor, Luxe Touch Luxury Resale will determine prices based on comparable prices for items of same or similar style, condition and brand. Please note that items will generally be offered for sale at 30-50% of original retail.
Markdowns up to 50% may occur on shoes and clothing. Handbags, accessories and jewelry as a rule will not see markdowns because they hold their value. However, Luxe Touch Luxury Resale reserves the right at any time, without prior consultation with the Consignor, to discount up to 10% in order to close a potential sale. Consignorswill be consulted before discounts of more than 10% are offered on handbags, accessories and jewelry.
7. Authenticity
All luxury goods MUST BE absolutely authentic and are subject to authentication. Consignor attests to the authenticity of all agreed upon items, and has not knowingly requested the resale of counterfeit goods. Items deemed to be counterfeits will either be returned to Consignor for a $100 authentication and shipping fee, or discarded. Any further business with the Consignor will be terminated indefinitely.
8. Shipping
Consignor is responsible for delivery or shipping of the agreed upon item/s to Luxe Touch Designer Consignment in good, clean condition otherwise it will be returned to the Consignor at Consignor’s expense.
9. Payment(s)
Consignors will be contacted by the 15th of the month when sales have been incurred the month prior. Consignors are paid by cheque after their items are sold and payment has cleared. Cheques are typically written on the 15th of every month. Amounts of less than $25 will be rolled over until the payout exceeds $25.
Luxe Touch Luxury Resale will provide the Consignor with detailed invoicing of all associated fees and accounting records pertaining to Consignors account. Luxe Touch Luxury Resale will maintain accurate books and documentation with respect to all transactions entered into on behalf of the Consignor.
10. Loss or Damage
Consignor will ensure that consignment items are insured from all risks of fire, theft, flood, accidental damage or breakage, any acts of nature resulting or any damage to the property while at Luxe Touch’s place of doing business. Luxe Touch Luxury Resale is not responsible for damaged or stolen merchandise.
11. Ownership
Consignor attests that they have legal title to and are in legal possession of all items and that which Luxe Touch Luxury Resale is to sell on behalf of the Consignor.
12. Agreement
Both parties have read and understand all statements included in this agreement. This agreement may not be revised or amended without the written consent of both the Consignor and Luxe Touch Luxury Resale.
