Consignment Contract

WHEREAS, the Consignor wishes to have certain items offered

by Luxe Touch Designer Consignment, and WHEREAS, Luxe Touch Designer Consignment  wishes to represent the Consignor under the terms and conditions of the agreement.

THE PARTIES AGREE:

1. Term

This agreement shall have a term of ninety (90) days minimum however, the consignment period for luxury items is a minimum of one hundred and eighty (180) days.  This contract is renewable at the discretion of either party.
If the Consignor wishes to end the contract and pick up any item before 90 days, there will be a fee of $35 as well as the associated commission that would have been due to Luxe Touch Designer Consignment upon the sale of the item.  Fee and commmission is due at the time of pickup and must be paid in cash.  Consignor must provide Luxe Touch Designer Consignment with 7 days notice for any item picked up before the minimum 90 day period.   Failure to respect the above terms will result in all consigned items being returned to the Consignor.
From time to time and/or at the end of the Spring/Summer and Fall/Winter seasons, Luxe Touch Designer Consignment pulls unsold merchandise in order to make room for new consignments.  Consignor will be contacted by email to let you know when items are ready to be picked up.  Consignors have 14 days form the date of that email to pick up their items.  One follow up phone call will occur before items are then donated to charity. 
Due to space limitations, Luxe Touch Designer Consignment does not provide storage of goods for consignors at any time. 

2. Fees
Consignor has choice of the following method of payment once goods are sold - 

Sale price up to $500 per item:  50% to consignor as store credit OR 45% to consignor as a cheque.
Sale price $501-$1000 per item and under: 60% to consignor as store credit OR 55% to consignor as a cheque.
Sale price $1001 per item and above: 70% to consignor as store credit OR 65% to consignor as a cheque.


3. Process
Priority acceptance of items is given to consignors who also purchase from Luxe Touch Designer Consignment.

Items are accepted at Luxe Touch Designer Consignment’s sole discretion based on a number of additional factors including current trends, brand, condition, demand and volume of items already in stock.  Luxe Touch may refuse to accept or return any or all items consigned at any time if the terms of  this contract are not respected. 
Upon receipt, Luxe Touch will take all necessary steps to sell your item.  Additionally, items may be sold on Luxe Touch’s websites.
Consignor attests that they are not offering and will not offer the item for sale via any other method or venue while the item is in the possession of Luxe Touch Designer Consignment.

4. Pricing, Discounts and Markdowns

In consultation with the Consignor, Luxe Touch Designer Consignment will determine prices based on comparable prices for items of same or similar style, condition and brand.   Please note that items will generally be offered for sale at 30-50% of original retail. 
From time to time and at Luxe Touch Designer Consignment’s discretion, markdowns may apply.  However, luxury goods will not see markdowns because they hold their value and prices are set based on brand, condition, current retail value, market demand and trends, secondary market prices amoungst other factors. 
Luxe Touch Designer Consignment reserves the right at any time, without prior consultation with the Consignor to a 10% margin in order to close a potential sale.
Consignor will be consulted before discounts of more than 10% are offered to buyers on luxury goods. 

5. Authenticity

All luxury goods MUST BE absolutely authentic and are subject to authentication at any time during the consignment period. Consignor attests to the authenticity of all agreed upon items, and has not knowingly requested the resale of counterfeit goods.  Items deemed to be counterfeits will either be returned to Consignor for a $100 authentication and shipping fee, or discarded.  Any further business with the Consignor will be terminated indefinitely.

6. Shipping

Consignor is responsible for delivery or shipping of the agreed upon item/s to Luxe Touch Designer Consignment  in good, clean condition otherwise it will be returned to the Consignor at Consignor’s expense.

7. Payment(s)

Consignors will be contacted by the 15th of the month when sales have been incurred the month prior.  Consignors can choose to spend the payout amount in store or request a cheque for the lesser amount.  Consignors can use their credit or request a cheque after their item(s) are sold and full payment has cleared. Cheques are typically written on the 15th of every month.  Amounts of less than $25 will be rolled over until a minimum of $25 has accrued.   

Luxe Touch will provide the Consignor with a detailed statement of all associated fees and accounting records pertaining to the Consignor's account.  Luxe Touch will maintain accurate books and documentation with respect to all transactions entered into on behalf of the Consignor.

8. Loss or Damage

Consignor will ensure that consignment items are insured from all risks of fire, theft, flood, accidental damage or breakage, any acts of nature resulting or any damage to the property while at Luxe Touch’s  place of doing business.  Luxe Touch Designer Consignment is not responsible for damaged or stolen merchandise.

10. Ownership

Consignor attests that they have legal title to and are in legal possession of all items and that which Luxe Touch Designer Consignment is to sell on behalf of the Consignor.

11. Agreement

Both parties have read and understand all statements included in this agreement. This agreement may not be revised or amended without the written consent of Luxe Touch Designer Consignment.
